Data collection on this website

Who is responsible for data collection on this website?

Data on this website is processed by the website operator. Their contact details can be found in the section “Information about the controller” in this privacy policy.

How do we collect your data?

Some of your data is collected when you provide it to us. This may, for example, be information you enter into a contact form.

Other data is collected automatically or with your consent by our IT systems when you visit the website. This primarily consists of technical data, such as your web browser, operating system or the time you accessed a page. This data is collected automatically as soon as you enter this website.

What do we use your data for?

Some data is collected to ensure that the website is provided without errors. Other data may be used to analyze your user behavior. Where contracts can be concluded or initiated through the website, the data submitted is also processed for contract proposals, orders or other order inquiries.

What rights do you have regarding your data?

You have the right at any time to obtain information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request that this data be rectified or erased. If you have given consent to data processing, you may withdraw it at any time with effect for the future. You also have the right, under certain circumstances, to request restriction of the processing of your personal data. In addition, you have the right to lodge a complaint with the competent supervisory authority.

You may contact us at any time about this or any other data protection questions.

2. Hosting

We host our website content with the following provider:

WIX

The provider is Wix.com Ltd., 40 Namal Tel Aviv St., Tel Aviv 6350671, Israel (hereinafter “WIX”).

WIX is a tool for creating and hosting websites. When you visit our website, WIX is used to analyze user behavior, visitor sources, the region of website visitors and visitor numbers. WIX stores cookies in your browser that are necessary to display the website and ensure security (necessary cookies).

Data collected through WIX may be stored on various servers worldwide. WIX servers are located in the USA, among other countries.

For details, please refer to the WIX privacy policy: https://de.wix.com/about/privacy.

According to WIX, transfers of data to the USA and other third countries are based on the European Commission’s standard contractual clauses or comparable safeguards under Article 46 GDPR. Details can be found here: https://de.wix.com/about/privacy-dpa-users.

WIX is used on the basis of Article 6(1)(f) GDPR. We have a legitimate interest in ensuring that our website is displayed as reliably as possible. Where the relevant consent has been requested, processing is carried out exclusively on the basis of Article 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent may be withdrawn at any time.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5626.

Processing on behalf of the controller

We have entered into a data processing agreement (DPA) for the use of the above service. This is an agreement required by data protection law, ensuring that the provider processes the personal data of visitors to our website only in accordance with our instructions and in compliance with the GDPR.

3. General information and mandatory disclosures

Privacy policy

The operators of this website take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection requirements and this privacy policy.

Various types of personal data are collected when you use this website. Personal data means information that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this takes place.

Please note that data transmission over the internet (e.g. communication by email) may have security vulnerabilities. It is not possible to provide complete protection of data against access by third parties.

Information about the controller

The controller responsible for data processing on this website is:

Visiomedical GmbH
Represented by Ms Frauke Papenbrock
Max-Winkelmann-Straße 42
48165 Münster

Telephone: +49 (0) 170 209 1734
Email: info@visiomedical.de

The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data (e.g. names, email addresses or similar information).

Retention period

Unless a more specific retention period is stated in this privacy policy, your personal data will remain with us until the purpose for processing it no longer applies. If you make a valid request for erasure or withdraw consent to data processing, your data will be erased unless we have other legally permissible grounds for retaining your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be erased once those grounds no longer apply.

General information about the legal bases for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Article 6(1)(a) GDPR or Article 9(2)(a) GDPR where special categories of data under Article 9(1) GDPR are processed. Where you have explicitly consented to the transfer of personal data to third countries, data processing is also based on Article 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g. via device fingerprinting), data processing is additionally based on Section 25(1) TDDDG. Consent may be withdrawn at any time. If your data is required for the performance of a contract or to take steps prior to entering into a contract, we process it on the basis of Article 6(1)(b) GDPR. We also process your data on the basis of Article 6(1)(c) GDPR where this is necessary to comply with a legal obligation. Data processing may also take place on the basis of our legitimate interest under Article 6(1)(f) GDPR. The following sections of this privacy policy provide information about the legal bases applicable in each case.

Recipients of personal data

In the course of our business activities, we work with various external bodies. This sometimes also requires personal data to be transferred to those external bodies. We disclose personal data to external bodies only where this is necessary for the performance of a contract, where we are legally obligated to do so (e.g. disclosure of data to tax authorities), where we have a legitimate interest in disclosure under Article 6(1)(f) GDPR, or where another legal basis permits the disclosure. When using processors, we disclose our customers’ personal data only on the basis of a valid data processing agreement. In the case of joint processing, an agreement on joint processing is concluded.

Withdrawal of your consent to data processing

Many data processing operations are possible only with your explicit consent. You may withdraw consent you have already given at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.

Right to object to data collection in specific circumstances and to direct marketing (Article 21 GDPR)

WHERE DATA IS PROCESSED ON THE BASIS OF ARTICLE 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THOSE PROVISIONS. THE RELEVANT LEGAL BASIS FOR PROCESSING CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS THE PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS FOR THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS (OBJECTION UNDER ARTICLE 21(1) GDPR).

WHERE YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION UNDER ARTICLE 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged infringement. The right to lodge a complaint is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to receive, or have a third party receive, data that we process by automated means on the basis of your consent or in performance of a contract, in a commonly used, machine-readable format. If you request direct transfer of the data to another controller, this will be done only where technically feasible.

Access, rectification and erasure

Within the scope of the applicable statutory provisions, you have the right at any time to obtain information free of charge about your stored personal data, its origin and recipients, and the purpose of processing, and, where applicable, the right to have this data rectified or erased. You may contact us at any time about this or any other questions concerning personal data.

Right to restriction of processing

You have the right to request restriction of the processing of your personal data. You may contact us at any time for this purpose. The right to restriction of processing applies in the following cases:

  • If you contest the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of that verification, you have the right to request restriction of the processing of your personal data.
  • If your personal data has been or is being processed unlawfully, you may request restriction of processing instead of erasure.
  • If we no longer need your personal data but you require it for the exercise, defense or establishment of legal claims, you have the right to request restriction of the processing of your personal data instead of erasure.
  • If you have lodged an objection under Article 21(1) GDPR, a balance must be struck between your interests and ours. Until it has been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.

If you have restricted the processing of your personal data, that data may, apart from storage, be processed only with your consent or for the establishment, exercise or defense of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the website operator, this website uses SSL or TLS encryption. You can recognize an encrypted connection by the browser address line changing from “http://” to “https://” and by the padlock symbol in your browser’s address bar.

When SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.

Objection to promotional emails

We hereby object to the use of contact details published to fulfill our statutory legal notice obligations to send advertising and informational materials that have not been expressly requested. The website operators expressly reserve the right to take legal action in the event of unsolicited advertising being sent, for example in spam emails.

4. Data collection on this website

Cookies

Our website uses “cookies”. Cookies are small data packets and do not damage your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted when your visit ends. Persistent cookies remain stored on your device until you delete them yourself or your web browser deletes them automatically.

Cookies may originate from us (first-party cookies) or from third-party companies (third-party cookies). Third-party cookies enable certain services provided by third-party companies to be integrated into websites (e.g. cookies for processing payment services).

Cookies serve various purposes. Many cookies are technically necessary because certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to analyze user behavior or for advertising purposes.

Cookies that are necessary for electronic communication, for providing particular functions you request (e.g. the shopping cart function) or for optimizing the website (e.g. cookies for measuring the website audience) (necessary cookies) are stored on the basis of Article 6(1)(f) GDPR unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies to provide its services without technical errors and in an optimized manner. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing takes place exclusively on the basis of that consent (Article 6(1)(a) GDPR and Section 25(1) TDDDG); consent may be withdrawn at any time.

You can configure your browser to notify you when cookies are set and to allow cookies only in individual cases, to reject cookies in certain cases or generally, and to activate automatic deletion of cookies when you close the browser. Disabling cookies may restrict the functionality of this website.

Information about any further cookies and services used on this website can be found in this privacy policy.

CCM19

Our website uses CCM19 to obtain your consent to the storage of certain cookies on your device or the use of certain technologies, and to document this in accordance with data protection requirements. This technology is provided by Papoo Software & Media GmbH, Auguststr. 4, 53229 Bonn (hereinafter “CCM19”).

When you enter our website, a connection is established to the CCM19 servers to obtain your consent and other declarations concerning the use of cookies. CCM19 then stores a cookie in your browser so that the consent you have given, or its withdrawal, can be assigned to you. Data collected in this way is retained until you request its erasure, delete the CCM19 cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

CCM19 is used to obtain the legally required consent for the use of cookies. The legal basis for this is Article 6(1), first sentence, point (c) GDPR.

Processing on behalf of the controller

We have entered into a data processing agreement (DPA) for the use of the above service. This is an agreement required by data protection law, ensuring that the provider processes the personal data of visitors to our website only in accordance with our instructions and in compliance with the GDPR.

Server log files

The website provider automatically collects and stores information in server log files, which your browser transmits to us automatically. This comprises:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not combined with other data sources.

This data is collected on the basis of Article 6(1)(f) GDPR. The website operator has a legitimate interest in displaying its website without technical errors and optimizing it; collecting server log files is necessary for this purpose.

Contact form

If you send us inquiries through the contact form, we store the information you provide in the inquiry form, including the contact details you enter there, for the purpose of handling your inquiry and any follow-up questions. We do not disclose this data without your consent.

This data is processed on the basis of Article 6(1)(b) GDPR where your inquiry relates to the performance of a contract or is necessary to take steps prior to entering into a contract. In all other cases, processing is based on our legitimate interest in handling inquiries addressed to us effectively (Article 6(1)(f) GDPR), or on your consent (Article 6(1)(a) GDPR) where this has been requested; consent may be withdrawn at any time.

The data you enter into the contact form remains with us until you request its erasure, withdraw your consent to storage, or the purpose for storing the data no longer applies (e.g. once your inquiry has been fully dealt with). Mandatory statutory provisions, in particular retention periods, remain unaffected.

Inquiries by email, telephone or fax

If you contact us by email, telephone or fax, we store and process your inquiry, including all personal data arising from it (name, inquiry), for the purpose of dealing with your request.

The data you send us through contact inquiries remains with us until you request its erasure, withdraw your consent to storage, or the purpose for storing the data no longer applies (e.g. once your request has been fully dealt with). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

Communication via WhatsApp

We use the instant messaging service WhatsApp, among other channels, to communicate with our customers and other third parties. The provider is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.

Communication is protected by end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from accessing the content of communications. However, WhatsApp has access to metadata generated during the communication process (e.g. sender, recipient and time). Please also note that, according to its own statements, WhatsApp shares its users’ personal data with its US-based parent company, Meta. Further details on data processing can be found in the WhatsApp privacy policy at: https://www.whatsapp.com/legal/#privacy-policy.

WhatsApp is used on the basis of our legitimate interest in communicating with customers, prospective customers and other business and contractual partners as quickly and effectively as possible (Article 6(1)(f) GDPR). Where the relevant consent has been requested, data processing takes place exclusively on the basis of consent; this may be withdrawn at any time with effect for the future.

The content of communications exchanged between you and us on WhatsApp remains with us until you request its erasure, withdraw your consent to storage, or the purpose for storing the data no longer applies (e.g. once your inquiry has been fully dealt with). Mandatory statutory provisions, in particular retention periods, remain unaffected.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/7735.

We use the “WhatsApp Business” version of WhatsApp.

Data transfers to the USA are based on the European Commission’s standard contractual clauses. Details can be found here: https://www.whatsapp.com/legal/business-data-transfer-addendum.

We have configured our WhatsApp accounts so that they do not automatically synchronize data with the address books on the smartphones in use.

We have entered into a data processing agreement (DPA) with the above provider.

5. Newsletter

Newsletter data

If you wish to receive the newsletter offered on the website, we need your email address and information enabling us to verify that you are the owner of that email address and agree to receive the newsletter. We use this data to send the information you have requested and do not disclose it to third parties. As part of newsletter campaigns, we may analyze various data (e.g. the time an email is opened, IP address, device information, links clicked and, where applicable, subsequent actions).

Data entered into the newsletter subscription form is processed exclusively on the basis of your consent (Article 6(1)(a) GDPR). You may withdraw your consent to the storage of your data and email address and their use for sending the newsletter at any time, for example via the “Unsubscribe” link in the newsletter. Withdrawal does not affect the lawfulness of data processing already carried out.

The data you provide for the purpose of receiving the newsletter is stored by us or the newsletter service provider until you unsubscribe, and is deleted from the newsletter mailing list after you unsubscribe or the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter mailing list at our discretion within the scope of our legitimate interest under Article 6(1)(f) GDPR.

Data stored by us for other purposes remains unaffected.

After you unsubscribe from the newsletter mailing list, your email address may be stored by us or the newsletter service provider in a suppression list where necessary to prevent future mailings. Data on the suppression list is used only for this purpose and is not combined with other data. This serves both your interest and our interest in complying with statutory requirements when sending newsletters (a legitimate interest within the meaning of Article 6(1)(f) GDPR). Storage on the suppression list is not subject to a time limit. You may object to this storage if your interests outweigh our legitimate interest.

Wix Email Marketing – additional provider information

We use Wix Email Marketing, a service provided by Wix.com Ltd., to send and manage our newsletter. For this purpose, Wix processes in particular your email address, any contact details you provide voluntarily, your subscriber status and information about delivery and unsubscription. The legal bases, retention periods and withdrawal options described above also apply to newsletters sent via Wix.

Wix provides statistics on the delivery and performance of email campaigns. Depending on the functions used, these may include information about emails opened and links clicked. Consent to receive the newsletter does not replace any required consent to additional performance measurement involving personal data. You may withdraw your consent with effect for the future via the unsubscribe link in the newsletter or by sending a message to info@visiomedical.de.

Wix processes recipient data as our processor. Processing may take place outside the EU or EEA. For the processing terms and transfer mechanisms, please also refer to the section Hosting – WIX, the Wix Data Processing Agreement and the Wix privacy information.

There is currently no newsletter subscription form embedded on this website. Submitting a consultation inquiry does not subscribe you to a newsletter.

6. Plugins and tools

YouTube in privacy-enhanced mode

This website embeds videos from YouTube. The website is operated by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of the pages on this website on which YouTube is embedded, a connection is established to the YouTube servers. The YouTube server is informed which of our pages you have visited. If you are logged in to your YouTube account, you enable YouTube to associate your browsing behavior directly with your personal profile. You can prevent this by logging out of your YouTube account.

We use YouTube in privacy-enhanced mode. According to YouTube, videos played in privacy-enhanced mode are not used to personalize browsing on YouTube. Ads displayed in privacy-enhanced mode are also not personalized. No cookies are set in privacy-enhanced mode. Instead, local storage elements are saved in the user’s browser; like cookies, these may contain personal data and be used for recognition. Details about privacy-enhanced mode can be found here: https://support.google.com/youtube/answer/171780.

Activating a YouTube video may trigger further data processing operations over which we have no control.

YouTube is used in the interest of presenting our online services attractively. This constitutes a legitimate interest within the meaning of Article 6(1)(f) GDPR. Where the relevant consent has been requested, processing takes place exclusively on the basis of Article 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent may be withdrawn at any time.

Further information about data protection at YouTube can be found in its privacy policy at: https://policies.google.com/privacy?hl=de.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards when data is processed in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

7. eCommerce and payment providers

Processing of customer and contract data

We collect, process and use personal customer and contract data to establish, define the content of, and amend our contractual relationships. We collect, process and use personal data concerning the use of this website (usage data) only insofar as this is necessary to enable users to use the service or to bill them for it. The legal basis for this is Article 6(1)(b) GDPR.

Customer data collected is erased after the order has been completed or the business relationship has ended and any applicable statutory retention periods have expired. Statutory retention periods remain unaffected.

08 / ADDITIONAL INFORMATION ABOUT THIS WEBSITE

Your choices and our website features

Cookie settings and withdrawal of consent

On your first visit, CCM19 offers a choice between “Reject all”, individual settings and “Accept all”. Technically necessary services remain available. YouTube is optional and is not loaded without your consent. You can use Cookie settings to change your choices or withdraw consent for YouTube at any time. An active YouTube embed is removed when the settings are opened. The lawfulness of processing carried out before consent was withdrawn remains unaffected.

Designs for Vision company video

The YouTube player is embedded only after you have consented to “YouTube Video” and clicked “Load video · YouTube”. We use youtube-nocookie.com in privacy-enhanced mode. Before this consent, the website loads neither the YouTube player nor a YouTube thumbnail. Privacy-enhanced mode does not mean that no data is processed during playback. Processing when loading has been authorized is based on Article 6(1)(a) GDPR and, insofar as information is stored on or read from your device, Section 25(1) TDDDG.

Preventive dentistry video and external links

The preventive dentistry video on the REVEAL landing page is delivered as our own video file via our Wix hosting and does not embed a YouTube player. It can also be played without consent for YouTube. Scientific publications and other websites are included as external links. You visit the respective provider only when you follow a link; that provider’s privacy information then applies.

WhatsApp, newsletters and technical integrations

WhatsApp Business and newsletters via Wix Email Marketing are used in our customer communications. There is currently no WhatsApp chat or newsletter subscription form embedded on this website. A consultation inquiry is not a newsletter subscription. No additional analytics or advertising tracking scripts and no externally loaded fonts are integrated into our website code. Technical processing by the providers described above remains unaffected.

09 / PERSONAL CONSULTATION

Your consultation inquiry

When you send us an inquiry, we process your name, email address, selected interest and the information you provide voluntarily: practice or clinic, telephone number, requirements and, where applicable, the transferred finder result. We also store your confirmation of the privacy information and your request to be contacted, as well as the technical submission data.

The form is submitted through Wix Forms and stored in the Wix dashboard. An internal notification, including a PDF of the submission, is sent to info@visiomedical.de. Wix is used as a service provider for technical processing. The information is used exclusively to handle your inquiry, reply to you personally and deal with possible follow-up questions. An inquiry is not a newsletter subscription.

For inquiries about a possible purchase or advice relating to it, Article 6(1)(b) GDPR provides the legal basis for steps prior to entering into a contract. We handle other inquiries on the basis of our legitimate interest in effective communication under Article 6(1)(f) GDPR. Where you give separate consent, Article 6(1)(a) GDPR applies; that consent may be withdrawn with effect for the future.

Use of the form is voluntary. Your name and email address are required so that we can identify and respond to your inquiry; other information is optional. Without the required information, submission through this form is not possible. Alternatively, you can contact us by email or telephone. In that case, we also process your contact details and the content of your inquiry in order to respond.

Please do not submit patient information or other confidential health data through the form.

10 / GUIDANCE

Loupe finder

The finder initially processes your choices concerning magnification, field of view, ergonomics and REVEAL in your browser. The information contained in the result is transmitted to us only when you include it in a consultation inquiry and submit that inquiry. Your selection alone does not trigger contact from us.

The rule-based product selection provides initial guidance and does not replace a personal consultation or individual measurements. It makes no decision on the conclusion of a contract or other legally significant claims. The finder does not carry out automated decision-making with legal or similarly significant effects.
